Sauna Warranty
1. INTERPRETATION
This document should be read in conjunction with our terms and conditions of sale and the provision of Services. A copy of that document is available at our website at www.kingspapools.com.au.
In this Agreement:
Customer means any person or entity who has purchased a Product from King Spa Pools or its authorised agent;
Commercial Purposes means any use that involves a fee, rate, charge or other consideration, any use directly or indirectly in connection with a business, going concern or undertaking intended for profit or pecuniary gain, and any non-residential use;
Domestic Purposes means when the Product is purchased for use by a single family for internal household purposes;
King Spa Pools means LLTSMM Pty Ltd Trading as King Spa Pools ABN 16 664 943 024;
Labour Warranty means a warranty provided by King Spa Pools to the Customer to cover the cost of any labour to replace defective or damaged parts of the Product.
Parts Warranty means a warranty provided by King Spa Pools to the Customer to cover a defect or any damage to the following materials or mechanical components of the Product:
a) componentry;
b) cabinet; and
c) heating element;
Product means any sauna provided by King Spa Pools or its authorised agent;
2. DOMESTIC SAUNA WARRANTY
If the Product is purchased and used by the Customer wholly for Domestic Purposes, King Spa Pools agrees to provide the following warranty to the Customer:
a) a 1 year parts warranty from the date of delivery for any defective or damaged componentry and cabinet of the Product;
b) a 1 year Parts Warranty from the date of delivery for any defective or damaged heating element of the Product; and
c) a 1 year Labour Warranty.
3. COMMERCIAL SAUNA WARRANTY
If the Product is purchased and used by the Customer wholly for Commercial Purposes, King Spa Pools agrees to provide the following warranty to the Customer:
a) a1 year Parts Warranty from the date of delivery for any defective or damaged componentry, cabinet and heating element of the Product; and
b) a 6 month Labour Warranty.
4. CONDITIONS OF DOMESTIC AND COMMERCIAL WARRANTIES
The Parts Warranty and Labour Warranty provided in clauses 2 and 3 herein will be made void if any of the following occurs:
a) if the Product is kept or stored outdoors for any period of time so as to expose the Product to weather conditions;
b) damage resulting from careless handling, improper location, storage or relocation (unless performed by us), painting, staining or other use of abrasive or improper chemicals;
c) damage caused by UV exposure;
d) lack of proper routine or preventative maintenance;
e) if the electrical wiring is connected by a non- licensed electrical contractor;
f) accidental damage to or theft of any part of the Product, including but not limited to the componentry, cabinet and heating element;
g) the Customer’s failure to maintain the Product in accordance with the manufacturer’s recommendations or our recommendations;
h) if the Product is misused, abused or neglected;
i) if there are any unauthorised maintenance, modifications, alterations, or repairs;
j) if the damage was caused by any third party negligence or defects in workmanship performed by other unauthorised third parties to the Product; and/or
k) if the Product is damaged as a result of any animal (including any termites and other wood destroying insects or rodents), act of God or natural disaster.
5. EXCLUSION OF RESIDENTIAL AND COMMERCIAL WARRANTIES
The Parts Warranty and Labour Warranty provided for in clauses 2 and 3 herein, does not extend to the following:
a) any defect or damage to the tempered glass door on the Product (if applicable);
b) any stain or dent made to the Product by any means; and
c) any deterioration of the Product that King Spa Pools considers, in its sole discretion, to be in fair wear and tear, including but not limited to scratches, debts or stains.
6. COVERAGE OF DOMESTIC AND COMMERCIAL WARRANTIES
a) King Spa Pools offers the Parts Warranty and Labour Warranty to all new Customers. The Parts Warranty and Labour Warranty is only valid for the original Customer and cannot be transferred under any circumstances.
b) The Parts Warranty and Labour Warranty coverage begins at the date of delivery. Written notice of any defect must be provided to King Spa Pools within 14 days of occurring. Failure to do so will void the Parts Warranty or Labour Warranty.
c) If the Product requires onsite repairs as part of the Parts Warranty or the Labour Warranty the Customer must provide full access into the property and location of the Product. King Spa Pools reserves the right to charge additional fees for transportation costs if the Customer resides in a regional area ora location outside 85 km radius of Slacks Creek Queensland.
d) King Spa Pools will at no stage accept liability for Products that are not accessible on all four sides. Failure to have access will result in repairs not being able to be completed. Removal of decking and fencing, damage to any landscape design, electrical costs associated with the disconnection of the Product and all other direct or indirect costs associated with the Parts Warranty or the Labour Warranty are at the Customer’s responsibility and cost. If the Product requires any off-site repairs or replacement all freight, electrical work, removal, and replacement costs shall be paid by the Customer both ways.
e) Repair or replacement of any defective Product is at the sole discretion of King Spa Pools.
7. LIMITATIONS TO DOMESTIC AND COMMERCIAL WARRANTIES
a) All warranties provided by King Spa Pools are set out in this document and excludes any other implied or oral undertakings or warranties. King Spa Pools or its agents will not be liable for any incidental or consequential losses or injury including but not limited to, any building related costs.
b) Under no circumstances shall the liability to King Spa Pools be greater than the amount paid for the Product by the Customer.
