Spa Warranty

1.  INTERPRETATION

a) The following warranties are offered by LLTSMM Pty Ltd Trading as King Spa Pools ABN 16 664 943 024. This warranty is offered subject to the conditions and exclusions as follows. The warranty is in addition to any compulsory statutory warranties which may apply to this product under the consumer law.

b) This document should be read in conjunction with our terms and conditions of sale and the provision of Services. A copy of that document is available at our website at www.kingspapools.com.au.

c) In this Agreement:

Customer means any person or entity who has purchased a Product from King Spa Pools or its authorised agent;

Commercial Purposes means any use that involves a fee, rate, charge, or other consideration, any use directly or indirectly in connection with a business, going concern, or undertaking intended for profit or pecuniary gain, and any non-residential use;

Domestic Purposes means when the Product is purchased for use by a single family for internal household purposes;

King Spa Pools means LLTSMM Pty Ltd Trading as King Spa Pools ABN 16 664 943 024;

Product means any spa provided by King Spa Pools or its authorised agent;

 

2.  10 YEAR STRUCTURAL WARRANTY

King Spa Pools warrants against failure in structural integrity of the spa, due to faulty workmanship or materials from the date of delivery for a period of 10 years, subject to limitations, conditions and exclusions expressed in this warranty.

 

3.  5 YEAR ACRYLIC SHELL WARRANTY

a) A 5 year warranty applies to the acrylic surface of the spa shell in respect of materials or workmanship that causes leaking of water to the inside of the Product’s cabinet for 5 years from the date of delivery. Chemical staining, fading, scratches or damage from UV exposure causing blistering to the acrylic shell are not covered under this warranty.

b) The hard cover must be on the Product when not in use. If the hard cover has not been used on the Product when it is not in use, the warranty is void and King Spa Pools does not extend any warranty to the Product.

 

4.  5 YEAR JET WARRANTY

King Spa Pools warrants the Jets faces against defects in materials or workmanship for a period of 5 years from the date of delivery. Jets must be returned to King Spa Pools or its dealer for inspection and replacement is limited to the supply of parts only.

 

5.  2 YEAR PUMP WARRANTY

a) King Spa Pools warrants the water pump against materials and workmanship for a period of 2 years from the date of delivery. After 1 year this warranty is limited to the supply and replacement parts only and excludes all labour and freight costs. The pump must be returned to King Spa Pools for inspection. Pump blockages and mechanical seals are not covered under this warranty.

b) Mechanical seal leaks are generally caused by incorrect water maintenance and will not be covered under this warranty.

 

6.  2 YEAR HEATER WARRANTY

King Spa Pools provides a warranty of 2 years from the date of delivery on the heater element and in respect of materials and/or workmanship. After 1 year this warranty is limited to the supply of replacement parts only and excludes all labour and freight costs.       

 

7.  2 YEAR PLUMBING & WATER LEAKS WARRANTY

King Spa Pools provides a warranty of 2 years from the date of delivery on the plumbing and water leaking inside the cabinet and only in respect of the materials or workmanship. After 1 year this warranty is limited to the supply of parts only and excludes all labour and freight costs.      

 

8.  2 YEAR CONTROL BOX DIGITAL TOUCH PAD WARRANTY

King Spa Pools provides a warranty of 2 years from the date of delivery on the control box and digital touch pad and only in respect of materials or workmanship. After 1 year this warranty is limited to the supply of parts only and excludes all labour and freight costs. Parts must be returned to King Spa Pools for inspection.

9.  1 YEAR WARRANTY ON THE FOLLOWING ITEMS

King Spa Pools provides a 1 year warranty from the date of delivery on the air blower, ozone unit, cabinets and hard covers. The warranty only applies to materials and/or workmanship and is limited to the supply of parts only. This warranty excludes all labour and freight costs. Parts must be returned to King Spa Pools for inspection.

 

10.  OTHER WARRANTIES

Replaceable service items such as pimp seals, O-rings, filters, filter lids, LED lights, lighting looms, light switches, waterfalls, waterfall control handles, air control handles, water diverters, fuses, bulbs and aroma therapy fittings are not covered under this warranty unless faulty at the time of delivery or collection. Any issues related to these items must be reported to King Spa Pools within 14 days of delivery and are limited to the supply of replacement parts only and excludes all labour and freight costs. All parts must be returned to King Spa Pools for inspection.

 

11.  RECONDITIONED SPA WARRANTY

All warranties specified in this document will be reduced to 1 year unless otherwise stated on the original purchase receipt.

 

12.  COMMERCIAL USE WARRANTY

All warranties specified in this document will be reduced to 1 year unless otherwise stated on the original purchase receipt. The warranty only covers replacement parts and excludes all labour.

 

13.  CONDITIONS OF WARRANTY

All warranties specified in this document will be made void if any of the following occurs:

a) damage resulting from incorrect water maintenance;

b) Failure to install the spa on a hard level surface;

c) damage caused by the lack of proper routine or preventative maintenance to any part of the Product. Damage caused by clogged or dirty filters;

d) if the Customer fails to maintain the Product in accordance with the manufacturer’s recommendations or King Spa Pools’ recommendations. If the Product is damaged as a result of not installing the spa on a sufficient hard level surface (unless installed by us);

e) if the Product is damaged as a result of incorrect electrical installation, brownouts, voltage spikes, or operating the spa outside plus/minus 10% of the voltage range;

f) if the electrical wiring is connected by a non- licensed electrical contractor;

g) the use of any power extension leads will void the warranty;

h) accidental damage to or theft of any part of the Product;

i) damage caused by any third-party carriers;

j) damage resulting from careless handling, improper location, storage, or relocation of the Product from its original installation location (unless performed by us), painting, staining, or other use of abrasive or improper chemicals;

k) if the Product is kept or stored outdoors for any period of time as to expose the Product to weather conditions;

l) damage caused by UV exposure;

m) damage caused by flooding caused by filling the Product with water beyond the water line recommended by the manufacturer or King Spa Pools;

n) if the Product is damaged as a result of any animal (including any termites and other wood destroying insects or rodents), an act of God, or a natural disaster;

o) damage caused by the Product being heated above 40 degrees celsius;

p) if the Product is misused, abused, or neglected;

q) if there are any unauthorised maintenance, modifications, alterations, or repairs; and/or

r) if the damage was caused by any third-party negligence or defects in workmanship performed by other unauthorised third parties to the Product.

 

14.  EXCLUSIONS OF WARRANTY

All warranties specified in this document do not extend to the following:

a) any free item that King Spa Pools provided to the Customer;

b) any stain or dent made to the Product by any means; and

c) any deterioration of the Product that King Spa Pools considers, in its sole discretion, to be fair wear and tear, including but not limited to, scratches, dents, or stains.

 

15.  COVERAGE OF WARRANTY

a) King Spa Pools offers this warranty to all our new Customers. This warranty is only valid for the original Customer and cannot be transferred under any circumstances.

b) This warranty begins at the date of delivery. Written notice of any defect must be provided to King Spa Pools within 14 days of occurring. Failure to do so will void this warranty.

c) If the Product requires onsite repairs the customer must provide full access to the property and location of the Product. King Spa Pools will at no stage accept liability for Products that are not accessible on all four sides with a minimum clearance of 800mm. Failure to have access will result in warranty work not being able to be completed. Removal of decking and fencing, damages to any landscape design, electrical costs associated with the disconnection of the Product, and all other direct or indirect costs associated with this warranty are at the Customer’s responsibility. If the Product requires any off-site repairs or replacement all freight, electrical work, removal, and replacement costs shall be paid by the Customer both ways.

d) King Spa Pools reserves the right to charge additional fees for transportation costs if the Customer resides in a regional area or a location outside an 85km radius of Slacks Creek Queensland.

e) Repair or replacement of any defective product is at the sole discretion of King Spa Pools.

 

16.  LIMITATIONS

a) All warranties provided by King Spa Pools are set out in this document and exclude any other implied or oral undertakings or warranties. King Spa Pools or its agents will not be liable for any incidental or consequential losses or injury including but not limited to, any building related costs.

b) Under no circumstances shall the liability to King Spa Pools be greater than the amount paid for the Product by the Customer.
